Hereinafter referred to as "The Customer" or "The Buyer"

1. Purpose

These General Terms and Conditions of Sale set out the contractual relationship between the Seller and the Customer, and the conditions applicable to any purchase made through the Seller's online store https://escandelle.com/, hereinafter referred to as "the Site".

Under these General Terms and Conditions of Sale, the Customer undertakes not to make any purchase for resale, within the meaning of Article L 110-1 of the French Commercial Code.

The Customer must be at least 18 years of age and have legal capacity, or hold parental authorisation allowing them to place an order on the Site.

Purchasing a product through the Site implies the Customer's full and unreserved acceptance of these General Terms and Conditions of Sale, which shall prevail over any other general or specific terms and conditions of the Customer.

The Seller reserves the right to amend these General Terms and Conditions of Sale at any time. It is, however, agreed that the terms applicable to the Customer shall be those in force on the date of their order on the Site.

These General Terms and Conditions of Sale are the exclusive property of the Seller. Any reproduction, even partial, is strictly prohibited.

2. The website

2.1 The Escandelle.com website (hereinafter the "Site") is an e-commerce website accessible via the Internet at https://escandelle.com/ and is open to all users of this network.

2.2 The Site offers for sale a range of women's clothing and accessories (hereinafter the "Product(s)") to Internet users browsing the Site (hereinafter the "User(s)"). For the purposes hereof, it is agreed that the User and Escandelle Paris shall be collectively referred to as the "Parties" and individually as a "Party", and that a User who has confirmed an order shall then be referred to as the "Buyer". The User's rights and obligations necessarily apply to the Buyer.

2.3 Escandelle Paris reminds you that the Products are intended exclusively for the Buyer's personal use, with no direct connection to the Buyer's professional activity. Escandelle Paris reserves the right to refuse to fulfil an order.

2.4 Any order for a Product offered on the Site requires the prior reading and express acceptance of the General Terms and Conditions of Sale by ticking the box provided for this purpose before placing the order.
As a reminder, in accordance with Articles 1316 to 1316-4 of the French Civil Code, supplemented by Decree No. 2001-272 of 30 March 2001 implementing Article 1316-4 of the Civil Code on electronic signatures, Escandelle Paris specifies that confirming the order form as set out in Article 5.3 below constitutes an electronic signature which, between the Parties, has the same value as a handwritten signature.

2.5 The purpose of the General Terms and Conditions of Sale is to define the rights and obligations of the Parties arising from the online sale of the Products offered on the Site.

3. Products and services

The products available on Escandelle Paris are described and presented as accurately as possible. However, errors or omissions may occur, which the Customer acknowledges and accepts.

4. Orders

- Any order placed on the website is considered firm and final once payment has been confirmed.

- The Seller reserves the right to refuse an order for legitimate reasons (stock issues, fraud, spam, etc.).

5. Prices and payment terms

- Prices are shown in euros (€), including all taxes.

- Delivery costs are shown during the checkout process.

- Payments can be made by bank card, PayPal or any other method offered on the website (Shop Pay, etc.).

6. Delivery

- Products are delivered to the address provided by the Customer when ordering.

- The Seller undertakes to meet the stated delivery times, except in cases of force majeure.

- Delivery costs and terms are specified before the order is confirmed.

7. Right of withdrawal

In accordance with European Directive 2011/83/EU and French law (Article L221-18 of the French Consumer Code):

- The Customer has 14 days from receipt of their order to exercise their right of withdrawal.

- To exercise this right, the Customer must contact the Seller via https://escandelle.com/apps/return_prime or eshop@escandelle.fr

Exceptions: The right of withdrawal does not apply to personalised products or products likely to deteriorate rapidly.

8. Legal guarantees

Products sold on Escandelle.com benefit from:

- The legal guarantee of conformity (Articles L217-4 to L217-14 of the French Consumer Code).

- The guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code).

9. Personal data

Escandelle.com collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and French law.

- The data collected is used solely for order management and to improve customer service.

- The Customer has the right to access, modify and delete their data by contacting Escandelle Paris.

10. Disputes and applicable law

- These Terms and Conditions of Sale are governed by French law.

- In the event of a dispute, the parties undertake to seek an amicable solution before referring the matter to the competent courts.
