Hereinafter referred to as “The Seller”

Any person wishing to make a purchase via the Seller's website, at the address https://escandelle.com/ ,
Hereinafter referred to as “The Customer” or “The Buyer”

ON THE OTHER HAND.

1. Purpose

These General Conditions of Sale aim to define the contractual relations between the Seller and the Customer, and the conditions applicable to any purchase made through the Seller's merchant site. https://escandelle.com/ , hereinafter referred to as “the Site”.

By these General Conditions of Sale, the Customer prohibits any purchase for resale, within the meaning of article L 110-1 of the Commercial Code.

The Customer must be at least 18 years old and have the legal capacity or hold parental authorization allowing him to place an order on the Site.

The acquisition of a product through the Site implies the full and complete acceptance by the Customer of these General Conditions of Sale. These will prevail over any other general or specific conditions of the Customer.

The Seller reserves the right to modify these General Conditions of Sale at any time. It is, however, agreed that the Conditions applicable to the Customer will be those in force on the date of the order on the Site.

These General Terms and Conditions of Sale are the exclusive property of the Seller. Any reproduction, even partial, is strictly prohibited.

2. The site

2.1 The Escandelle.com website (hereinafter the “Site”) is an e-commerce site accessible via the Internet at the address https://escandelle.com/ and is open to any user of this network.


2.2 The Site offers for sale a variety of clothing and accessories for women (hereinafter the “Product(s)”) to Internet users browsing the Site (hereinafter the “User(s)”). For the purposes of this Agreement, it is agreed that the User and Escandelle Paris will be collectively referred to as the “Parties” and individually referred to as the “Party”, and that the User who has validated an order will then be referred to as the “Buyer”. The rights and obligations of the User necessarily apply to the Buyer.

2.3 Escandelle Paris reminds that the Products are exclusively dedicated to the personal use of the Buyer and this, without any direct relation to the latter's professional activity. Escandelle Paris reserves the right to refuse execution of the order.


2.4 Any order for a Product offered on the Site implies consultation and express acceptance of the General Conditions of Sale by checking the box provided for this purpose before any order.
As a reminder, in accordance with the provisions of Articles 1316 to 1316-4 of the Civil Code, supplemented by Decree No. 2001-272 of March 30, 2001, taken for the application of Article 1316-4 of the Civil Code and relating to electronic signatures, Escandelle Paris specifies that the validation of the order form as specified in Article 5.3 below, constitutes an electronic signature which has, between the Parties, the same value as a handwritten signature.

2.5 The General Conditions of Sale are intended to define the rights and obligations of the Parties arising from the online sale of the Products offered on the Site.

3. Products and Services

The products available on Escandelle Paris are described and presented with the greatest possible accuracy. However, errors or omissions may occur, which the Customer acknowledges and accepts.

4. Orders

- Any order placed on the site is considered firm and final after validation of payment.

- The Seller reserves the right to refuse an order for legitimate reasons (stock problems, fraud, spam, etc.).

5. Prices and payment terms

- Prices indicated are expressed in euros (€), all taxes included (TTC). 

- Delivery costs are indicated during the ordering process. 

- Payments can be made by credit card, PayPal, or any other method offered on the site (ShopPay, etc.).

6. Delivery

- The products are delivered to the address indicated by the Customer when ordering. 

- The Seller undertakes to respect the delivery times indicated, except in cases of force majeure. 

- Delivery costs and terms are specified before the order is confirmed.

7. Right of withdrawal

In accordance with the provisions of European Directive 2011/83/EU and French legislation (article L221-18 of the Consumer Code): 

- The Customer has 14 days from receipt of their order to exercise their right of withdrawal. 

- To exercise this right, the Customer must contact the Seller via https://escandelle.com/apps/return_prime or eshop@escandelle.fr

Exceptions: The right of withdrawal does not apply to personalized products or products likely to deteriorate quickly. 

8. Legal guarantees

Products sold on Escandelle.com benefit from: 

- The legal guarantee of conformity (articles L217-4 to L217-14 of the Consumer Code). 

- Guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).

9. Personal data

Escandelle.com collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and French law. 

- The data collected is used only for order management and improving customer service. 

- The Client has the right to access, modify, and delete their data by contacting Escandelle Paris.

10. Disputes and applicable law

- These T&Cs are governed by French law. 

- In the event of a dispute, the parties undertake to seek an amicable solution before resorting to the competent courts.
